2. OBTAIN A WRITTEN FEE AGREEMENT, every time, unless the client is a prior client and you have an established relationship. In that case, paper the file anyway, if not with a formal fee agreement, at least with a letter to the client indicating the terms of this new representation. It is usually not required that the client sign the fee agreement (check the rules), but it is generally a good practice. The client will be hard pressed to claim they never saw the fee agreement and therefore is unenforceable if their signature is on it.
